Gay 'American Idol' contestant sues, says producers told him

American Idol contestant Ian Benardo is suing the show's producers claiming he was the subject of anti-gay discrimination and harrassment.

Benardo was featured during the 2007 American Idol season as one of the auditions gone bad. After getting a unanimous rejection from the Idol judges for his abyssmal audtion to Laura Branigan's 'Gloria,' he threw a diva fit that got him a little William Hung-style internet heat.

Ian Benardo popped up at the 2010 American Idol finale at Nokia Theater LA Live this summer as part of comedian Dane Cook's silly song tribute to Simon Cowell. Benardo says that after he was hired to return for the American Idol finale, he was repeatedly asked: "Why don't you act more faggy?"

Benardo told the New York Daily News that the American Idol set was a workplace "permeated with discriminatory intimidation, ridicule, insults and hostile and offensive comments."

Benardo is suing American Idol for $300 million stating that he suffered panic attacks as a result of the discrimination.

Sad thing is that I would bet this gentleman as well as Alvin Greene, Democratic nominee for the U.S. Senate from South Carolina, would do a better job than most of the tools we have in government.

Judge Puts Hold on Key Arizona Immigration Law Provisions
Aspects of SB 1070 Set to Take Effect Thursday, Legal Challenges Continue

Arizona’s tough new immigration law was just hours away from taking effect when a federal judge issued an injunction today blocking key portions of the law from being enforced.

Among the provisions U.S. District Judge Susan Bolton put on hold are the “reasonable suspicion” section that would allow police to arrest and detain suspected illegal immigrants without a warrant and a provision making it illegal for undocumented day laborers to solicit or perform work.

Bolton also stayed part of the Arizona law requiring immigrants to carry federal immigration documents.

“There is a substantial likelihood that officers will wrongfully arrest legal resident aliens under the new [law],” Bolton ruled. “By enforcing this statute, Arizona would impose a ‘distinct, unusual and extraordinary’ burden on legal resident aliens that only the federal government has the authority to impose.”

Some aspects of the measure, listed as SB 1070, will take effect Thursday as planned. It will become a crime for state officials to interfere with or refrain from enforcement of federal immigration laws. It will also be illegal to pick up and transport day laborers across the state, or to give a ride to or harbor an illegal alien. A vehicle used to transport an illegal alien can be impounded.

“The Court by no means disregards Arizona’s interests in controlling illegal immigration and addressing the concurrent problems with crime including the trafficking of humans, drugs, guns, and money,” Bolton wrote. But the court “finds that preserving the status quo through a preliminary injunction is less harmful than allowing state laws that are likely preempted by federal law to be enforced.”

Lawyers for the U.S. Justice Department have argued the law interferes with the ability of the federal government to set and enforce national immigration policy.

“While we understand the frustration of Arizonans with the broken immigration system, a patchwork of state and local policies would seriously disrupt federal immigration enforcement and would ultimately be counterproductive,” DOJ spokeswoman Hannah August said in support of today’s ruling.

“It’s a preliminary injunction so it’s not final,” said attorney Linton Joaquin with the National Immigration Law Center, which is party to one of the lawsuits challenging the law. “But the judge showed the most egregious provisions are pre-empted by federal law.”

“It’s good news for everybody,” said Ali Noorani of the National Immigration Forum. “For now, all residents of Arizona will remain protected under the law.”

Supporters of the law were disappointed at today’s ruling but pointed out that the blocked provisions could still take effect after the court resolves legal questions surrounding them.

Opponents of Arizona’s immigration enforcement law SB 1070 celebrate after it was announced that a judge blocked some controversial provisions of the law on July 28, 2010 in Phoenix, Arizona. U.S. District Court Judge Susan Bolton issued a preliminary injunction preventing several sections of Arizona’s new immigration law from going into effect, at least until the courts have a chance to hear the full case.

(John Moore/Getty Images)”Today the Federal Government got relief from the courts to not do their job,” said Gov. Brewer. “We knew regardless of what happened today of course one side or the other side was going to appeal. So this begins the process. This is an injunction. They haven’t heard really the merits of the bill.”

Steven Camarota of the Center for Immigration Studies, which favors the Arizona law, said today’s decision was not unexpected. “The law had a lot of safeguards built into, but ultimately the judge didn’t believe that Arizona could implement the law in an unproblematic way. This is strange because it assumes that, but there hadn’t been any cases of misuse of the law.”

Arizona Senators John McCain and Jon Kyl also expressed disagreement with the court’s opinion and called the federal lawsuit against Arizona a “waste of taxpayer resources.”

“The Obama Administration should have focused its efforts on working with Congress to provide the necessary resources to support the state in its efforts to act where the Federal government has failed to take responsibility,” they said in a statement.

What’s Next in Legal Fight OverArizona Law?

“After a preliminary injunction there is a trial on the permanent injunction,” said New York Law School professor Lenni Benson.

The judge “can dissolve it later if, after greater consideration or development of more facts and time to assess the law, the judge thinks the law goes the other way.”

The legal process is expected to drag on for months, after which, legal experts say, parties may still appeal parts of the decision they don’t like. The debate over SB 1070 could reach the U.S. Supreme Court.

“This is a significant decision, and the litigation, as it proceeds to a final decision…and probable appeal, has potentially historic dimensions,” said Hiroshi Motomura of the UCLA School of Law.

“Almost all state and local efforts to address immigration outside the law in this generation have focused on areas of traditional state regulation, such as employment and housing,” Motomura said. “SB 1070 much more clearly is a direct attempt to address and regulate immigration itself. This is why the federal government had to take action in this case, in order to maintain its constitutional position as the exclusive authority on who is let into the United States, who must leave, and ultimately, who is or can become an American.”

Immigrants Have Been Bracing for Arizona Law

Meanwhile, law enforcement officers across Arizona are preparing to enforce the measures not blocked today.

So what’s the difference whether you enforce another crime, which is the illegal immigration? So we are very comfortable” enforcing the law, Maricopa County Sheriff Joe Arpaio said on “Good Morning America.”

Many immigrant families have begun fleeing the state afraid of the new law’s impact, and some activists are even encouraging immigrants to check tail lights on their cars, not to travel in large groups, and remove the Catholic rosaries from their rear-view mirrors.

Erika, a 23-year-old undocumented Mexican student living in Mesa, Ariz., since 1998, says her family is relieved with today’s court ruling.

“Yesterday I went to bed really depressed,” she said. “This morning, knowing this, everything came back. The hope, the faith, knowing that those prayers are really working.”

This means the community won’t be as afraid to go with their friends, go out to the store,” said Nicole Torres, who was participating at church vigil outside Phoenix after the ruling. “They hopefully will still feel safe enough to call the police now that they will no longer require you know checking of documentation.”

Rosario Peralta, an illegal immigrant who runs a south Phoenix grocery store, said some of the frightened families that had planned to move out of the state appear to be rethinking their decisions.

“I was worried about my customers..business was slow, but it’s going to get better,” she said.

The Arizona immigration law, which passed in late April, has attracted international attention and sparked protests around the country. It faces legal challenges in six lawsuits, in addition to the one filed by DOJ.

Sixty percent of Americans support the Arizona law, according to the most recent ABC News/Washington Post poll. But fewer — 46 percent — think the states should have power to make and enforce their own immigration laws, one criticism of the Arizona statute.

You must present that ID to any official of the police regardless of what police anytime they stop and ask you for it. If you are an illegal they throw you in jail — You must not be aware of the new policies Mexico put in place in 2008… You should read a bit.

I assume that since ABC World News ran a story tonight that showed an “undocumented immigrant” on camera who had been in the country illegally since age 11 (she was obviously in her twenties now), the the Obama administration will immediately dispatch ICE agents to take her into custody since it is the Obama administration’s position that the Federal Gov’t is the enforcer of immigration laws. If not, then WHO is going to enforce those laws.

ajasys- well written post. But as a LEGAL U.S. citizen I am already living like that. If I choose to cross the border, I do it legally and show my passport. If I am stopped by the police I have to show my drivers license. If I didn’t have it, I would expect to be detained. If I use a credit card, they sometimes ask for i.d.! This law isn’t about pulling over everyone that “looks” illegal (which would be impossible). It is about proving your are here legally (and not breaking yet ANOTHER law) after you are already the subject of a police stop. How is that a problem? My willingness to prove my citizenship illustrates the level of frustration w/the situation here in AZ.

delighted_to_be_here: I recently traveled to China and always kept my travel documents, (papers), in a safe place at my host’s home. I was cautioned by the US Consulate NOT to carry my passport, etc. on my person, but to make COPIES of them for the purposes of identification when I was among the people.

The colonies were LEGALLY British possessions – or later on, were the Sovereign States of America. (The USA.) Both entities were LEGAL and the immigrants who came here that way were also LEGAL. The idea that the land belonged to the Native Americans omits the fact of CONQUEST. Even Mexico was conquered by Spain. Before that, many large tribes took land AND slaves by CONQUEST. The map of Europe changed, even until recently, by CONQUEST. In Africa, slaves were taken and land was obtained by CONQUEST. You may not like what I write and it might not be the best way to have done things, but it is a FACT of our world.

I am very disappointed in the ruling by Judge Bolton. It saddens me that the issue of illegal immigration has become a democratic versus republican battle. Illegal immigration is really an issue that affects both democratic and republican citizens alike. There should be a unified front from both parties on this issue. If you stop to consider the financial position of this country and our future, it’s only common sense that we need to crack down on illegal immigration. This country already has extensive programs and funding available to support our poor but legal citizens. Adding to it is a fast growing aging population, and you are left with very few “legal citizens” who are working and paying taxes to support all of these areas. The additional financial burden of illegal citizens to this equation can not be ignored. I work in the public school system and see first hand the extra costs. Schools have to provide an education to everyone, regardless of immigration status. But to educate an illegal immigrant costs tax payers even more than to educate one of our own citizens. Why you might ask? Many reasons, they typically don’t speak the English language well and the school systems have to employ extra resources (special teachers) to educate them, and they often get government support such as free breakfast and lunch. Yes, the schools give away free breakfast and lunch to those who are in need, and lets face it, these immigrants are typically on the lower end of the economic scale and therefore eligible. It seems those who are crying the loudest about the immigration debate in Arizona are illegal immigrants themselves. Really, does there opinion count? I would gladly stop and answer questions from a police officer regarding my immigration status and respect those who are trying to protect our borders. But again, I’m a legal citizen with nothing to hide.

Police Find The Body of Ex-NBA Player Lorenzen Wright

Curtis Wright told the Associated Press that police called the player's father, Herb Wright, Wednesday afternoon with the news he had died. There was no immediate word on the cause.

Police declined to comment publicly, even to some family members who gathered at the scene. The Commercial Appeal cited a police source as identifying a body found in a field in southeast Memphis as Wright's.

Nearly 50 people gathered next to a road blocked off by police beside a wooded area about 15 miles south of downtown Memphis, while helicopters showed investigators scouring the grounds for evidence.

The 34-year-old Wright was last seen July 18 when he was expected to fly out of town. His family filed a missing person report July 22.

Wright played 13 years in the NBA with five different teams: the Los Angeles Clippers, Atlanta Hawks, Memphis Grizzlies, Sacramento Kings and most recently the Cleveland Cavaliers with 17 games in the 2008-09 season. Wright left the University of Memphis early for the NBA, and the Clippers made him a lottery pick with the No. 7 selection overall.

He averaged 8 points and 6.4 rebounds per game in 778 career games.

Former NBA star Penny Hardaway, who played at Memphis two years before Wright, said he heard the news from a friend and went to the scene near where the body was found.

"I cried. The emotions hit me immediately. It's just sad because we lost a good person and a brother," Hardaway said.

Elliot Perry, another friend and former Memphis player, also was at the scene. Wendy Wilson, who once worked as Wright's personal assistant, also was there and said Wright often used the road police had cordoned off as a shortcut to his mother's house.

"He was a good person. He did not deserve to die this way. God is not pleased with this," Wilson said.

Saturday's 6-2 win over the Rangers at the Ballpark at Arlington was a start for the Angels, who trail the Rangers by six games, but they're still just 3-5 against the Rangers this season after going 8-11 against Texas last year.

The Angels will look for a split in their four-game set in Texas with right-hander Trevor Bell making his first start of the season on Sunday while the Rangers will counter with right-hander Tommy Hunter.

Bell, who is 1-1 with a 6.05 ERA in 15 relief appearances this season, is the latest addition to the Angels rotation with left-hander Scott Kazmir on the disabled list and right-hander Sean O'Sullivan being traded to the Royals for third baseman Alberto Callaspo.

Sunday will mark his fifth career start, as the 23-year-old made four starts last season, going 1-2 with a 6.20 ERA in those four outings.

But he's been solid with Triple-A Salt Lake this season with a 2-0 record and a 3.00 ERA in six starts, and reached 83 pitches in his most recent outing at Salt Lake, before working the ninth inning of O'Sullivan's win against the Yankees in the series opener on Tuesday night.

"I'll be at 100 [pitches] if they need me to be," Bell said. "I feel good about the way I've been throwing. My last start I went six innings, four strikeouts, no walks."

Hunter, meanwhile, is still perfect on the season with a 7-0 record and a 2.09 ERA in nine outings. The 24-year-old was also solid in his last start, when he threw seven scoreless innings against the Tigers on Tuesday and picked up the win.

"Tommy has been terrific," Rangers shortstop Elvis Andrus said. "He's been great. He goes out there and fights every inning. That's what makes him so special."

Angels: Kazmir breathes sigh of relief
Angels left-hander Kazmir, who is on the 15-day disabled list with a fatigued left shoulder, said Saturday that he received good news from Rangers team physician Dr. Keith Meister. "The MRI [taken Thursday] was better than good, Dr. Meister told me," Kazmir said. "He said, `Yes, there are some abnormalities, but that's always going to be there for someone who has been pitching for six years.' For as long as I've been throwing, he said it's way above normal. That was a big relief."

Rangers: Teagarden called up for injured Treanor
Catcher Matt Treanor was placed on the disabled list with a strained right PCL he suffered on Friday against the Angels and fellow catcher Taylor Teagarden was called up from Double-A Frisco to take his place on the roster. "Being down in Double-A and the team doing as well as they have up here, it's not easy for me to think about coming up here anytime soon," Teagarden said. "With an injury like that, anything can happen. I'm just grateful to be here...anything I can do I'll be ready."

Worth noting
Angels second baseman Howard Kendrick, who entered Saturday leading the AL in games played with 97, was given the day off with Maicer Izturis getting the start at second base. ... The Rangers set their rotation for their upcoming series against the A's and Angels. Left-hander Cliff Lee will pitch the opening game against the A's on Tuesday, followed by Colby Lewis and C.J. Wilson, while in Anaheim the Rangers are expected to start Scott Feldman in the opener before following him up with Tommy Hunter and Lee in the finale. ... The Rangers officially inducted Tom Grieve, who is currently serving as a Rangers broadcaster, into the club's Hall of Fame on Saturday at the Ballpark in Arlington.

The 32-year-old told MovieHole: 'I think people would love to go see a movie called The F**k Buddies. If I saw a poster and it said 'The F**k Buddies', I'd be like, 'I'm in, I'm going to see it'.'

Part of the reason Kutcher starred in the film was because of its name, and he is hoping film executives don't change it.

The husband of actress Demi Moore added: 'I think it's going to be a really, really funny movie. I can't think about it without laughing. That should be the title - I'm shooting for that.'

For the past couple of weeks, Dallas-based rappers Memphis Blac (AKA Arapaho) and her niece Smokahontas Jones have been blazing up the viral-video circuit with their magnum opus, "Got Dat Work." It's an unabashed streetwalker's anthem, in which the two women wear jewelry fashioned from Magnum condom wrappers and attempt to empower women of the oldest profession. And the chorus is, well, unforgettable: "I got that work/I'ma push it like a dope bitch/Cross-country/Slangin' pussy like I move bricks."

It's a cross-country, unifying effort as well. The video was shot in Miami-Dade — including Hialeah and South Beach — over this past Memorial Day weekend. Local guy Matthew Hoyos of Circle Tree Multimedia directed the video, which, as of this writing, is up to more than 91,000 views on YouTube alone — not bad for two otherwise unknown independent artists. (The pair owes most of its Internet notoriety, however, to WorldStarHipHop, which first posted the clip June 10.)

Memphis Blac isn't new to the music game, though. She's been rapping since 1994 and claims affiliations and recording history with J Prince of Rap-a-Lot Records, Texas legend Pimp C, Devin the Dude, and other Southern greats. "J Prince from Rap-a-Lot told me I was a soldier," she recalls. "He knew the talent, but at the time I was still running wild, just going too hard on the streets to concentrate on a rap career."

"Got Dat Work" has spurred plenty of Internet criticism for its apparent condoning of prostitution. Ironically, the most hateful comments are found on the same hip-hop blogs where songs about the drug trade, gang life, and indiscriminate violence are often celebrated.

Herein lies the Catch-22 that has kept men from investing in Blac as an artist. In an industry founded on "keepin' it real," Blac is considered too real. "They tell me I'm too damn hard," she says. "What the fuck I'm 'posed to be, a piece of cotton?"

She says she was born in 1965 in Tennessee, where she lived with no running water and no bed. Childhood sexual abuse led to decades spent as a sex worker before Blac finally quit turning tricks to open a legitimate business called Precious Treats. It's an ice-cream and hamburger shop, named for her dead sister, in the Dallas projects.

But even when she was prostituting and living the dope-fiend street life recounted in her music, she was using the proceeds to help friends and neighbors, and especially their kids. "Bitch, consider me akin to Mother Teresa. I have took care of families and families off working this pussy," she says. "I hustle for these kids, or else they end up in the pen, or dead, or wrapped up in this bullshit."

She says her music is an attempt to raise awareness about condom use, the dangers of sex work, and to expose the reality and ubiquity of prostitution in America. Blac also adds that money raised through her music will go to her urban outreach programs for at-risk youth — though currently there is no product for sale.

Precious Entertainment, Blac's recording concern, is putting up the money to jump-start a career that she says male CEOs were afraid to touch. "Somebody have to have the balls; these niggas not gonna do it," she says. "We just two made bitches comin' in on they own bankroll."

Anna Fermanova, a native of Latvia, was arrested on July 15 for attempting to smuggle night-vision scopes on a March 1 flight from John F. Kennedy International Airport in New York to Russia, according to federal authorities.

Fermanova, a 24-year-old cosmetology student, allegedly violated the Arms Export Control Act after attempting to take $15,000 worth of high-tech equipment without proper export licenses to Russia, according to CNN.

Fermanova was allowed to complete her trip to Moscow, but was arrested after her return to suburban Plano, Texas. She was released the next day on $50,000 bail.

“Fermanova stated that she had purchased the scopes online,” an affidavit pertaining to her arrest warrant read.

When questioned about the federal regulations related to night-vision equipment, Fermanova told Immigrations and Customs Enforcement agents that she had “signed something about that” but was unsure of “what she was signing,” according to the affadavit.

Scott Palmer, Fermanova’s attorney in Dallas, maintains that his client was not involved in espionage.

"There's no terrorist connection," Palmer told CNN. "She is not a spy. The items were intended to be sold to a family friend for hunting purposes."

Fermanova – who will be arraigned in New York, where the equipment was confiscated – intends to plead not guilty, Palmer said.

Palmer will not rule out the possibility of negotiating a plea with the government, he said.

Roush plane crashes in Wisconsin — Pit Road Scene

Jack Roush has been hospitalized with non-life-threatening injuries suffered from a crash that occurred as he attempted to land his plane Tuesday night at Wittman Regional Airport in Oshkosh, Wis., according to a statement from Roush Fenway Racing and a statement posted on the website of the Experimental Aircraft Association.

The EAA’s annual AirVenture event is this week in Oshkosh.

The Raytheon Premier jet, registered to Roush Fenway Racing, was split in half during the landing accident, which occurred at about 7:15 p.m. ET.

According to the EAA, the National Transportation Safety Board and Winnebago County Sheriff’s Department confirmed the two occupants on board were team co-owner Jack Roush and Brenda Stricklin, who each exited the aircraft following the accident. Both were transported to local hospitals. Roush was in serious but stable condition with injuries that were not life-threatening, according to the Roush Fenway Racing statement. Stricklin also was hospitalized with injuries not considered life-threatening, according to the EAA.

Jason McDowell, an aviation photographer who was at the airport, tweeted a photo of Roush exiting the plane with a bloody face.

Roush nearly lost his life while piloting a small plane near Troy, Ala., on his 60th birthday on April 19, 2002. He hit a power line and landed upside down in eight feet of water. The longtime NASCAR team owner was not breathing when he was rescued and sustained a broken leg, a collapsed lung and head injuries.
